These Rules and Regulations are intended to assure the public that the Anderson Island Park & Recreation District (hereinafter called AIPRD), located in Pierce County Washington, will operate and maintain recreation lands and facilities in a safe and attractive condition for the use and enjoyment of all members of the public without discrimination.

These rules and regulations shall apply to all property owned and/or operated by the AIPRD including Andy’s Wildlife Park (including the off-leash dog exercise area), Andrew Anderson Marine Park, Cammon Field and Trail (New School), Montalvo Park, The Old Schoolhouse (Wide Awake Hollow), Tom White Park, Lowell Johnson Park (The Ol’ Swimming Hole), Tom’s Park, Idie Ulsh Park, Saint Anne’s Woods, The Guthrie Center, and any additional properties the AIPRD shall acquire and designate as parks.

Section 1: Definitions

“Anderson Island Park & Recreation District” shall mean the area included within the boundaries of Anderson Island within unincorporated Pierce County for the purpose of taxing property within said boundaries for maintenance and operation of the area parks property and facilities (hereafter called AIPRD).
“Anderson Island Park & Recreation District Board” shall mean the governing body of the Anderson Island Park & Recreation District made up of elected or appointed Commissioners (hereafter called the AIPRD Board of Commissioners).
“Camping” shall mean erecting a tent or shelter or arranging bedding, or both, or parking a recreational vehicle or other vehicle for the purpose of remaining overnight.
“Commissioner” shall mean any of the duly elected or appointed Anderson Island Park & Recreation District Commissioners, and/or their duly authorized agents or designees.
“Motor Vehicle” means any self-propelled device capable of being moved upon a road, and in, upon, or by which any persons or property may be transported or drawn, and includes, but is not limited to, automobiles, trucks, tractors, motorcycles, motor scooters, four-wheel drive vehicles, all terrain vehicles ATVs) and snowmobiles, whether or not they can legally be operated upon the public highways.
“Park” means and includes all AIPRD grounds and associated drives and parking areas; trails, athletic fields, play grounds and beaches; play, recreation, historic and restroom/dressing room structures within property boundaries, owned or operated by the AIPRD, and under the management and control of the AIPRD Board.
“Permit” means written authorization or permission issued by the AIPRD Board to a group or organization desiring to use AIPRD property for a specific purpose (special event) in advance of that event.
“Person” shall mean all individuals, firms, partnerships, corporations, clubs, and all associations or combinations of persons whether acting for themselves or by means of an agent, servant, or employee.
“Special Event” shall mean a group recreation activity in or on AIPRD property, sponsored or organized by an individual or organization that requires reserving park areas, planning, facilities, staffing, or other services beyond the level normally provided at AIPRD property to ensure public welfare and safety, and facility or environmental protection.
“Trail” means any path or track designed for use by pedestrians, bicycles, or equestrians,
and which is not of sufficient width, nor designed to permit its use by standard passenger automobiles; or other rights-of-way specifically designated and posted for non-vehicular use.

Section 2: Access and Hours of Operation

Any person, except persons specifically authorized by the Anderson Island Park & Recreation District Board, or other persons authorized by law, shall be prohibited from entering, going upon or remaining upon any property outside the established hours of operation; or property that has been designated and posted by the AIPRD as a “no admittance” or “closed to use” or “no trespassing” area.

The established hours of operation for AIPRD parks are daily from 30 minutes before sunrise to 30 minutes after sunset, year-round, unless otherwise posted.
No overnight parking or camping is permitted on AIPRD property, except by permit as provided in Section 17 (Park Use Scheduling, Permits and Fees) of these rules.

Section 3: Protection of Property and Natural Surroundings

No person shall while upon or within property of the Anderson Island Park & Recreation District:

Willfully mutilate, injure, deface or destroy any guidepost, notice, sign or enclosure;
Climb any tree or walk, stand or sit upon monuments, vases, fountains, railing, fences, or upon any other property not designated or customarily used for such purposes;
Cut, break or mark upon any building, bridge, wall, fountain, hedge, or other structure;
Appropriate, excavate, injure or destroy any historical ruin or any object of antiquity, or otherwise harm any work for the protection or ornamentation of any park or parkway;
Enter or break into any locked restroom or any other building or structure;
Remove, damage or destroy any equipment, tools or materials;
Remove any earth, boulders, gravel or sand, without written permission of the AIPRD Commissioners.
Climb upon, cut, break, injure, destroy, take or remove any tree, shrub, timber, plant or natural object; Exceptions are listed below in subsections a) and b):

a) The following fruits, nuts, berries or unoccupied seashells may be gathered by hand for personal use or consumption, in accordance with the noted size, quantity, collection sites and/or use or consumption restrictions. The gathering or possession of edible fruits and berries is limited to one liter (1.0 quart) per person per day.

b) The following plants may be harvested for personal use (no commercial harvesting) using ethical foraging practices defined by sustainable wildcrafting sources: harvest 1/3 or less of a plant in a given stand, and only if the plant is plentiful and not at risk. Section 4: Protection of Wildlife

No person shall while upon or within property of the Anderson Island Park & Recreation District:

Hunt, pursue, trap, kill, injure or molest any wildlife, terrestrial or aquatic, or disturb their habitats;
Take any fish from waters of any park, except in conformity with the rules and regulations of the State Department of Fish and Wildlife ; additionally, no fishing of any kind is allowed in Andy’s Marine Park. Shellfish harvesting is not allowed in any park.
Permit any domesticated animal, where allowed, to be unleashed or un-tethered at any time, except as provided in Section11 (Pets and other Domesticated Animals) of these rules;

Section 5: Fires

No person shall while upon or within property of the Anderson Island Park & Recreation District:

Build or maintain any fire in any property except in areas designated for such purposes and in structures such as fire pits and fireplaces provided for such use;
Build or maintain an open fire during an officially declared “burn ban” affecting Anderson Island;
Leave a fire unattended, or permit a fire to spread or extend beyond the approved containment structure.
This section shall not be construed to prohibit the use of barbecues or other portable stoves in such place and manner as not to create a hazard.

Section 6: Firearms and other Weapons Restricted

It is unlawful for any person while upon or within property of the Anderson Island Park & Recreation District to:

Possess a firearm with a cartridge in any portion of the mechanism in a park, or discharge across, in or into any park a firearm, air or gas weapon, or any device capable of injuring or killing any person or animal or damaging or destroying any public or private property;

All laws, rules and regulations of the State of Washington relating to WAC 332-52-145 Fire Arms and Target Shooting, and Chapter 9.41 RCW, FIREARMS AND DANGEROUS WEAPONS are also applicable and will be enforced.

Section 7: Fireworks Prohibited

It is unlawful for any person while upon or within property of the Anderson Island Park & Recreation District to:

Possess, discharge, set off or cause to be discharged in or into any park, any firecracker, torpedo, rocket, firework, explosive or other substance potentially harmful to the life or safety of persons or property. Legal fireworks as part of a permitted function which are licensed and in compliance with State regulations may be discharged in a manner meeting all safety requirements if authorized by the Anderson Island Park Board or designee and if handled by a licensed professional;

Section 8: Smoking, Vaping, Alcohol & Controlled Substances Prohibited

No person shall while upon or within property of the Anderson Island Park & Recreation District:

Smoke or vape. For the purposes of this Section, "smoke" or "smoking" means the carrying, holding, or smoking of any kind of lighted pipe, cigar, cigarette, or any other object that is used for smoking.
Display, possess or consume alcoholic beverages;
Open a package containing or consume cannabis. "Cannabis" is as defined by RCW 69.50.101 as now or hereafter amended.
Display, possess or consume controlled substances. "Controlled substance” is as defined by RCW 69.50.101 as now or hereafter amended.

Section 9: Personal Conduct

No person shall while upon or within property of the Anderson Island Park & Recreation District:

Be under the influence of intoxicants or illegal drugs;
Engage in any violent, abusive, loud, vulgar, obscene or otherwise disorderly conduct;
Disturb or annoy park patrons;
Prevent any other person from entering or leaving, or making full use of the park through the use of force, threats or any other means;
Interfere with, or in any manner hinder any AIPRD official or their agents in the performance of their official duties;
Use a powered public address system, amplified music speaker system, sound-emitting electronic equipment including electrical speakers, radio, phonographs, television, or other such equipment, at a volume which emits sound beyond the immediate individual that may disturb other park patrons;
Engage in any activity that is potentially hazardous to public safety or park property, or incompatible with park property use as designated and posted by the AIPRD;
Play games or participate in activities in a manner and/or location that may subject people or personal property, park resources or facilities to risk, injury, or damage.

Section 10: Peddling and Soliciting Prohibited

No person shall while upon or within property of the Anderson Island Park & Recreation District:

Engage in commercial solicitation, or sell, rent or peddle any services, goods, wares, merchandise, liquids, or edibles for human consumption, except by concession or written permission granted by the AIPRD Board of Commissioners;
Post signs, posters, advertising, decoration, notices or anything similar;
Hold or participate in any religious or political meeting or other assembly, or distribute literature without first obtaining permission from the AIPRD Board of Commissioners.

Section 11: Pets and Other Domestic Animals

Dogs, other pets, horses and domestic animals are generally prohibited upon and within properties of the Anderson Island Park & Recreation District – including being left unattended in a vehicle – with the following exceptions:

Service animals, including guide or signal dogs or other animals individually trained to do work or perform tasks for an individual with a disability are permitted in all parks and facilities, as are dogs used by law enforcement or other public safety personnel.
Cammon Park, Wildlife Park, Deweyert-Claussen Trail, Idie Ulsh Park, Tom’s Park
a. Dogs are allowed on leash or tether, and must be under control by the owner or handler at all times;

b. Owner or handler must not allow their dog to bite, molest, or otherwise annoy or disturb the peace and tranquility of the park or other park visitors;

c. Owner is liable for damage or injury inflicted by their dog(s);

d. Owner or handler is responsible for cleaning up their animals’ waste deposits, and must have the equipment necessary to do so in their possession;
Andy’s Wildlife Park Off-Leash Dog Exercise Area

a. Dogs exhibiting dangerous or aggressive behavior, puppies under four (4) months of age, female dogs in heat, and unattended dogs are not allowed;

b. Other dogs are allowed off leash or tether, but must be under control by the owner or handler at all times;

c. Choke or pinch collars must also be removed while dogs are off leash;

d. Dogs must be on leash or tether when outside the off-leash area;

e. Owner or handler must carry a leash for each and every dog they bring into the off-leash area;

f. Owner or handler must not allow their dog to bite, molest, or otherwise annoy or disturb other park visitors;

g. Owner is liable for damage or injury inflicted by their dog(s);

h. Owner or handler is responsible for cleaning up their animals’ waste deposits, and must have the equipment necessary to do so in their possession;

i. Owner or handler must be inside the Park gates with their dog(s) at all times;

j. Park visitors must secure all gates upon entrance and departure;

k. Use of the off-leash area is at the user’s own risk.

Section 12: Camping

Camping upon or within property of the Anderson Island Park & Recreation District is by permit only, and as provided for in Section 17.

Section 13: Swimming, Bathing and Wading

No person shall while upon or within property of the Anderson Island Park & Recreation District:

Swim, bathe, or wade except at such times and places as may be provided or designated for such purpose;
Leave a child unaccompanied by an adult in or near a lake, watercourse or Puget Sound;
Appear in a complete or partially nude or naked condition.

Section 14: Littering and Polluting Prohibited

No person shall while upon or within property of the Anderson Island Park & Recreation District:

Leave, deposit, drop, or scatter bottles, broken glass, ashes, waste paper, cans, or other rubbish, except in a garbage can or other receptacle designated for such purposes;
Deposit any household or commercial garbage, refuse, waste, or rubbish, which is brought as such from any private property, in any garbage can or other receptacle designed for such purpose;
Drain or dump refuse or waste from any trailer, camper, motor home, automobile, or other vehicle;
Clean fish or other food, or wash any clothing or other articles for personal or household use, or any dog or other animal;
Clean or wash any automobile or other vehicle;
Pollute, or in any way contaminate by dumping or otherwise depositing any waste or refuse of any nature, kind, or description, including human or animal waste, so it may enter into any stream, lake or other body of water running in, through or adjacent to any AIPRD property.

Section 15: Use of Motor-Driven Vehicles

No person shall while upon or within property of the Anderson Island Park & Recreation District:

Operate a motorized vehicle on other than paved or graveled roadways and parking areas intended for such purpose. “Paved or graveled roadways” as used in this sub-section does not include paved ways designated for the exclusive use of pedestrians, bicycles, wheelchairs or other vehicles used to provide reasonable accommodation under the ADA Act (except for service vehicles);
Park or leave standing a motorized vehicle in any AIPRD area, except where the operator is using the area for a designated recreation purpose and the vehicle is parked in a designated parking area;
Park, leave standing, or abandon a vehicle on any AIPRD property after closing time, except as provided for with an Overnight Parking Permit issued by the AIPRD Board.

a. Any vehicle found parked in violation of subsection 2 or 3 of this section may be towed and impounded at the owner’s or operator's expense.

Section 16: Use of Non-Motorized Vehicle

Non-motorized vehicles, including cycles, scooters, rollerblades, and skateboards, but excluding wheelchairs, are generally prohibited upon and within properties of the Anderson Island Park & Recreation District, with the following exceptions:

Street-legal cycles may operate on all roadway and parking surfaces approved for motorized vehicles, and in accordance with the rules for motorized vehicles (see section 15);
Human-powered cycles are prohibited on all trails within the AIPRD with the exception of the Jane Cammon Walking and Bicycle Trail with the following restrictions:

a. Persons operating non-motorized cycles on this trail must

i. Ride to the right of the trail;

ii. Obey all trail signage;

iii. Yield to pedestrians;

iv. Slow down, make presence known well in advance, and use courtesy and caution when approaching or overtaking hikers or other cyclists;

v. Observe a maximum trail speed of 10 miles per hour;

vi. Dismount and walk in congested areas and posted walk zones;

vii. Wear an approved helmet;

viii. Keep the cycle on the established trail surface.

Section 17: Drones

No person shall while upon or within property of the Anderson Island Park & Recreation District operate motorized model aircraft, drones, unmanned aircraft systems (UAS), or unmanned aerial vehicles (UAV) except as authorized by the Board of Commissioners. Requests must include purpose of flight, specific area of use, how captured data will be used, proof of registration or compliance with federal and state laws, and any other information requested by the Board.

Section 18: Park Special Use Authorization, Scheduling, and Fees

Anderson Island Park & Recreation District facilities are operated and maintained for the public’s use and enjoyment. These facilities are generally available without reservations or fees to individual persons or groups for activities and events consistent with the rules and regulations of the AIPRD. However, the Anderson Island Park and Recreation District reserves the right to establish and impose fees as deemed appropriate.

Special uses of AIPRD properties and facilities not otherwise allowed by the general rules and regulations for park use may be authorized by the Board of Commissioners on a case by case basis by permit or contract with the requesting party. Special uses may include, but are not limited to overnight use, reserved use for profit and nonprofit special events, and commercial use of facilities consistent with AIPRD policy and goals. A use, participation or rental fee and/or damage deposit may be charged by the District in instances where special use may result in additional expenses to the District for administration, utilities, maintenance, upkeep, supervision or security.

The Anderson Island Park & Recreation District will require an agreement to indemnify the District against all loss or damages arising from or out of a special use permit or contract. As a condition of special use, the District may also require a surety bond or liability insurance with the District named as an additional insured party.

To be considered, a request for park special use must be submitted in writing to the Anderson Island Park & Recreation District Board of Commissioners at 11408 Guthrie Rd, Suite B, Anderson Island, WA 98303, no less than 45 calendar days prior to the beginning date of the planned event or activity.

Section 19: Rules and Regulations Promulgation

The Anderson Island Park & Recreation District is a duly formed and authorized municipal corporation as defined in RCW 36.69.130. The District has the power to, among other things, make and enforce rules and regulations governing the use of property, facilities or equipment and the conduct of persons thereon, and to make or establish charges, fees, rates, rentals and the like for the use of facilities (including recreational facilities) or for participation.

Section 20: Failure to Comply

Failure to comply with these rules and regulations, or with any other federal, state or local law, rule or regulation applicable under the circumstances, shall subject the person so failing to submit to ejection from any property, and possible prosecution by the civil authority having jurisdiction. Violations of rules or regulations adopted by a park and recreation district for the preservation of order, control of traffic, protection of life or property, or for the regulation of the use of park property constitute misdemeanors in accordance with RCW 36.69.180.

Section 21: Laws and Regulation

Anderson Island Park & Recreation District rules and regulations are designed to be consistent with federal, state or local law, rule or regulation. Any rule or regulation that is inconsistent with federal, state or local law or found to be otherwise void shall not affect the application of all other valid rules and regulations. Patrons are ultimately responsible to ensure that their conduct is within the law of whichever civil authority has jurisdiction, regardless of compliance with AIPRD property rules and regulations.
